Statement regarding settlement of litigation
Olsen v. City of Oakland, et al.
Oakland, CA –The City of Oakland has agreed to a settlement of Scott Olsen v. City of Oakland, et al. for the amount of $4.5 million.
Under the terms of the settlement, the City of Oakland will pay the plaintiff $1.8 million. The City’s insurance carrier will pay the balance of the settlement.
During an “Occupy Oakland” protest on October 25, 2011, Mr. Olsen was struck in the head with a flexible baton round. A flexible baton is a cloth-enclosed, lead-filled round fired from a shotgun. Mr. Olsen suffered a fractured skull and other injuries, including traumatic brain injury. He sued the City in December 2012 (U.S. District Court Case No. C12-06333-SI).
Statement from City Attorney Barbara Parker:
“Mr. Olsen suffered a tragic injury that will affect him for the rest of his life. This settlement will save the City the far greater costs of a trial and potentially much higher judgment. This is a fair settlement given the facts of the case and the significant injuries Mr. Olsen sustained.”
