The mission of the Executive Management Team is to:
ensure efficient coordination, cooperation and communication amongst and between the three divisions of the Office of the City Attorney,
maximize our performance in the delivery of excellent client service, and
foster a spirit of teamwork in the Office of the City Attorney.
The Operations Division directs, sets policy for and manages the work of the Office of the City Attorney, consistent with the City Charter, federal and state laws, Court rules and procedures and City Council goals and priorities. View Org Chart >
This division provides centralized administrative support and a wide variety of specialized legal and financial services to the Office of the City Attorney, including:
investigating, negotiating and adjusting claims made against the City,
appearing in small claims court,
providing paralegal, secretarial and clerical support,
assistance with administrative record requests,
budget preparation and monitoring,
accounts payable and payroll.
This division maintains and supports all automated systems in the office, including document management; claims, litigation, project and file management; time accounting; and master calendar management.
The Operations Division is also responsible for information technology and legal communication, including community and media relations.
The Advisory Division provides legal advice and counsel to the City of Oakland in areas of municipal law including: land use, real estate, personnel, elections, conflict of interest, municipal finance, municipal bonds, retirement, housing and economic development. View Org Chart >
The 21 attorneys in the Advisory Division:
draft and review contracts and legislation;
provide litigation services in personnel and retirement arbitrations, and in related areas (such as probate and bankruptcy);
defend the validity of ordinances and other administrative actions;
provide legal services related to code enforcement and drug nuisance abatement;
provide counsel to Council committees, retirement boards, Business Tax Board of Review, Civil Service Board, Planning Commission, Citizens Police Review Board, task forces, and City agencies and departments;
provide legal representation to Council-created Joint Powers Authorities such as Chabot Science Center and Observatory and Oakland Base Reuse Authority;
handle elections and conflict of interest issues.
The Division also staffs the Open Government Program which monitors compliance with open meeting laws and responds to public records issues.
The Litigation Division advocates the City's interest in lawsuits filed against or on behalf of the City, its officers, employees and agencies. The division's 13 litigators represent the City in the state and federal court systems. View Org Chart >
Generally legal claims and lawsuits involve the following issues:
inverse condemnation,
civil rights,
wrongful death,
eminent domain,
personnel disputes,
employee disciplinary appeals before the Civil Service Board or before Hearing officers,
"dangerous condition of public property", and
personal injury.
