On January 23, 2024, Alameda Superior Court Judge Noël Wise issued the Court’s final decision in Oakland Bulk and Oversized Terminal (OBOT) v. City of Oakland (Case Nos. RG18930929/RB20062473).
In response to that decision, City Attorney Barbara J. Parker issued the following statement:
“The City of Oakland welcomes the final resolution of this litigation at the trial court level, which will allow the City to proceed with an appeal from the trial court’s ruling in favor of the developers on liability. Although we appreciate that the trial court ultimately correctly rejected OBOT’s attempts to obtain hundreds of millions of dollars in damages that it is not entitled to under the contract or law, the City’s position remains that the court erred in making its initial finding in favor of OBOT on the City’s and OBOT’s dueling breach of contract claims. The City will continue to evaluate all of its legal options as it pursues its rights to bring this longstanding dispute to final resolution.”
